Gallatin County Commission to meet Wednesday, discuss Bear Canyon Road agreement

The regular Tuesday meeting of the Gallatin County Commission has been rescheduled to Wednesday at 1:30 p.m. due to the June 8 primary election.

The commission is scheduled to discuss an interim agreement regarding Bear Canyon Road, the source of an ongoing dispute between the county and U.S. Forest Service.

The problem started in the fall of 2007 when the Forest Service used heavy equipment to obliterate a county-owned road in the canyon southeast of Bozeman.

Although the Forest Service replaced the road with a 50-inch wide trail, the county didn't feel it was adequate for recreation access and livestock grazing, said Chris Gray, deputy county attorney.

After several years of negotiations between the county, Forest Service, Montana Department of State Lands and the Montana Department of Environmental Quality, an agreement has been drafted in an attempt to reach a full settlement of the issue, Gray said.

Basically, if the Forest Service agrees to replace the road with a permanent public-access easement, the county would abandon its interest in the road, Gray said.

The goal is to have a final agreement in place by Dec. 1, 2010.

The commissioners will hold a public hearing on the matter Wednesday.

In other business, commissioners are scheduled to:

• Open competitive sealed bids for commissioning provider services for the new detention facility.

• Hold a public hearing and decide on rescinding the county's road abandonment procedures.

• Hold a public hearing and decide on a resolution relating to the A.O. Group's application for Recovery Act bonds.

• Hold a public hearing and decide on a request for a conditional-use permit for Bridger Ski Foundation for firework sales.

• Appoint a new member to the Solid Waste Management District.

The commission will meet at 1:30 p.m. in the Gallatin County Courthouse community room, 311 W Main St. The meetings are televised on community cable television and audio streamed on the county's website, www.gallatin.mt.gov. The full agenda may also be viewed there.
