Box 818, Bozeman, MT 59771-0818 a Home Equity Line of Credit Agreement ("Agreement") governing their line of credit of $250,000.00. 2. As security for the above-described Agreement, Monte B. Kemper and Wanda J. Kemper, as Grantors, delivered a Deed of Trust dated February 5, 2004, naming Monte B. Kemper and Wanda J. Kemper, whose address is 3640 Jagar Lane, Bozeman, MT 59718, as Grantors; Allied Title Company, whose address is 106 E. Babcock, Suite C, Bozeman, MT 59715, as Trustee; and Big Sky Western Bank, whose address is Bozeman Branch, 4150 Valley Commons Drive, P.O. Box 818, Bozeman, MT 59771-0818, as Beneficiary and Lender. The above-mentioned Deed of Trust was recorded on the 11th day of February, 2004 at 11:00 a.m. as Document No. 2140228, in the Clerk and Recorder's Office of Gallatin County, Montana. On December 9, 2011 at 2:13 p.m., J. Robert Planalp, Attorney at Law was substituted as Trustee for Allied Land Title Company by Document No. 2403324, in the Clerk and Recorder's Office of Gallatin County, Montana. The new trustee's address is 27 North Tracy, P.O. Box 1, Bozeman, Montana 59771. 3. That pursuant to the above-mentioned Deed of Trust, the Grantors, above named, irrevocably granted and conveyed to Trustee, in trust, with power of sale, the following described real property and improvements: The land described is situated in State of Montana, County of Gallatin, and described as: Tract 1 of Certificate of Survey No. 1032, located in the Southwest Quarter of Section 28, Township 2 South, Range 5 East, P.M.M., Gallatin County, Montana, according to the official plat thereof on file and of record in the office of the County Clerk and Recorder of Gallatin County, Montana. The Real Property or its address is commonly known as 3640 Jagar Lane, Bozeman, MT 59718. The Real Property tax identification number is RGG8411. 4. That the above-mentioned Agreement requires Grantors make a Regular Monthly Payment in the amount of Grantors' monthly finance charges or $100.00 whichever is greater. Grantors were to make 179 of these consecutive monthly payments. They then were required to pay the entire balance owing in a single balloon payment. If they made only the minimum payments, they may not have repaid any of the principal balance by the end of this payment stream. Their payments were due monthly. Their "Minimum Monthly Payment" would be the Regular Payment, plus any amount past due and all other charges. An increase in the annual percentage rate would increase the amount of their Regular Payment. 5. That Monte B. Kemper and Wanda J. Kemper are in default of the Agreement for their failure to make the following monthly payments: September 15, 2010, $667.81; October 18, 2010, $776.98; November 15, 2010, $623.29; December 17, 2010, $824.73; January 17, 2011, $683.39; February 15, 2011, $645.55; March 18, 2011, $834.15; April 15, 2011, $623.28; May 16, 2011, $713.44; June 15, 2011, $667.81; July 18, 2011, $800.26; August 15, 2011, $723.29; September 15, 2011, $757.95; October 17, 2011, $2,149.23; November 15, 2011, $645.55; and December 16, 2011, $872.61; and January,12 2012 $704.54; and February 15, 2012, $644.02. Also, Grantors have failed to pay the required real estate taxes, with the second one-half of 2009, all of 2010 and the first one-half of 2011 installments now delinquent for the years 2009, 2010 and 2011. Grantors have violated the "due on sale" clause in the Deed of Trust by their conveyance of the above-described real property as evidenced by the recorded Notice of Agreement for Sale of Real Estate between Grantors and Randall S.C. Lundgren and Shannon K. Lundgren dated September 29, 2009 and recorded on that same date in the Clerk and Recorder's Office of Gallatin County, Montana as Document No. 2343270. Grantors have allowed or created a senior lien on the collateral and through inaction allowed the creation of other liens on the Beneficiary's collateral. As a result of the defaults, the Beneficiary has elected to accelerate the obligation. 6. That pursuant to the terms of the Agreement and the Deed of Trust as a result of the defaults, as of March 1, 2012, there is now due the balance of unpaid principal, which is $263,646.07, together with accrued interest of $44.40, late charges of $33.39, other charges including recording fees of $47.00 totaling the sum of $263,770.86, together with interest accruing at the rate set forth in the Agreement from and after November 29, 2011 together with all delinquent real estate taxes, delinquent escrow for taxes and insurance plus late charges, attorneys fees, trustees fees, interest which are now owed and which may be due or become due prior to the date of sale. Beneficiary may disburse such amounts as may be required to protect beneficiary's interest. If Beneficiary elects to make such disbursements, sums paid shall become additional indebtedness secured by the Deed of Trust. Additionally, trustee's sale guaranty was an additional cost of $959.00. 7. That the Beneficiary has elected to proceed to sell the above-described real property and improvements located thereon pursuant to the provisions of the Deed of Trust described herein and the Small Tract Financing Act as adopted in the State of Montana. The sale will be held on the 9th day of July, 2012, at 11:00 a.m. Mountain Standard Time or Mountain Daylight Time, whichever is in effect. The sale will be held at the office of the Trustee, which is 27 North Tracy, Bozeman, Montana 59715. This is an attempt to collect a debt and any information obtained will be used for that purpose.
